How long does Probate take in NSW?

For straightforward estates, a grant of Probate from the NSW Supreme Court usually takes around 3 to 6 months from the date of filing — provided the application is in order and the Will is uncontested.

Delays happen when documents are missing, beneficiaries can't be located, or the estate is contested. We manage the full probate and estate administration process so it moves as quickly as possible.

Can I contest a Will in NSW?

Yes — but only if you're an "eligible person" under the Succession Act 2006 (NSW). That generally includes a spouse, de facto partner, child, former spouse, dependant or a person in a close personal relationship with the deceased.

You also have a strict 12-month time limit from the date of death to lodge a family provision claim. The sooner you get advice, the more options you'll have — read more about contesting or challenging a Will.

Are DIY Wills really a good idea?

In our experience, no. DIY Will kits and online templates are one of the biggest causes of estate litigation we see — unclear wording, missing witnesses, or assets that aren't properly accounted for can leave your family fighting in court for years.

Can I claim against an estate I was left out of?

A family provision claim lets an "eligible person" ask the NSW Supreme Court to award them a greater share of an estate — whether they were left out of the Will, or received less than they reasonably needed for their maintenance, education or advancement in life.

You must lodge within 12 months of the date of death, and the Court weighs your financial position, your relationship with the deceased, the size of the estate and any competing claims. We act for both claimants and executors — see our guide to family provision claims for the full process.
